1. AGREEMENT TO OUR LEGAL TERMS

We are AdventureSIMs (‘Company’, ‘we’, ‘us’, or ‘our’), a company registered in Australia. We operate the website https://adventuresims.com (the ‘Site’), the mobile application AdventureSIMs (the ‘App’), and any other related products and services that refer or link to these legal terms (the ‘Legal Terms’) (collectively, the ‘Services’).

AdventureSIMs is an online platform that enables users to purchase and manage prepaid eSIM data plans. Our service provides digital delivery of eSIM profiles, allowing users to activate mobile data on compatible devices without a physical SIM card. AdventureSIMs acts as a reseller of telecommunications services provided by third-party network operators.

These Legal Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (‘you’), and AdventureSIMs concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or by notifying you via email. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.

The Services are intended for users who are at least 18 years old. We recommend that you print a copy of these Legal Terms for your records.

2. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the ‘Content’), as well as the trademarks, service marks, and logos contained therein (the ‘Marks’).

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

  • all registration information you submit will be true, accurate, current, and complete;
  • you have the legal capacity and you agree to comply with these Legal Terms;
  • you are not a minor in the jurisdiction in which you reside; and
  • your use of the Services will not violate any applicable law or regulation.

4. PUSH NOTIFICATIONS (MOBILE APP)

By using the App, you agree to receive transactional push notifications related to your account and purchases (e.g., order status, data usage warnings). These notifications are a core part of the Service provided by the App. You can manage your notification preferences at any time through your mobile device’s system settings.

5. USER REGISTRATION

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password.

6. eSIM PRODUCTS AND SERVICES

We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

  • Device Compatibility: It is the User’s sole responsibility to ensure that their device is both eSIM compatible and network-unlocked before purchasing an eSIM. By ticking the checkbox at checkout, you acknowledge that you have confirmed your device’s compatibility. AdventureSIMs cannot be held responsible if you purchase an eSIM for an incompatible or locked device.
  • Delivery of eSIMs: All products are delivered digitally. Upon successful payment, your eSIM will be made available to you instantly within the AdventureSIMs App and/or sent to your registered email address as a QR code.

7. PURCHASES AND PAYMENT

We accept the following forms of payment: Visa, Mastercard, American Express, PayPal, Apple Pay, and Google Pay.

Payments are processed securely by our third-party payment processor, Stripe. By submitting payment information, you authorise Stripe to process your payment and agree to their terms. We do not collect or store your full credit card details. To the fullest extent permitted by law, we disclaim any liability for any acts or omissions by Stripe.

You agree to provide current, complete, and accurate purchase and account information for all purchases. Sales tax will be added to the price of purchases as deemed required by us. All payments shall be in Australian Dollars (AUD). We reserve the right to refuse any order placed through the Services.

8. REFUND POLICY

  • Unactivated eSIMs: If you have not yet activated or downloaded your purchased eSIM (i.e., the QR code has not been scanned), you are eligible for a full refund within 30 days of the purchase date.
  • Activated or Downloaded eSIMs: Once an eSIM has been activated or an installation attempt has been made, it is no longer eligible for a refund, except in the case of a verifiable technical fault with the service itself. To request a refund, you must cooperate with our support team in a troubleshooting process. If a technical fault originating from AdventureSIMs is identified and cannot be resolved, a refund or credit will be issued.
  • Non-Refundable Scenarios: Refunds are unavailable if the User’s device is not eSIM compatible or is network-locked, the eSIM was unused due to personal plan changes, the plan has expired, or for data top-up purchases.

9. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make them available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us. As a user of the Services, you agree not to:

  • Systematically retrieve data from the Services to create a collection or database without our written permission.
  • Trick, defraud, or mislead us and other users.
  • Circumvent or interfere with security-related features of the Services.
  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
  • Use any information obtained from the Services to harass, abuse, or harm another person.
  • Make improper use of our support services or submit false reports.
  • Engage in any automated use of the system, such as using scripts or data mining tools.
  • Interfere with, disrupt, or create an undue burden on the Services.
  • Attempt to impersonate another user or use the username of another user.
  • Sell or otherwise transfer your profile.
  • Use the Services as part of any effort to compete with us or for any revenue-generating endeavour.

10. USER REVIEWS AND CONTRIBUTIONS

While the Services do not generally offer users the ability to submit or post content, we may provide you with areas on the Services to leave reviews or ratings. When posting a review, you must comply with the following criteria:

  • you should have firsthand experience with the entity being reviewed;
  • your reviews should not contain offensive profanity, or abusive, racist, or hateful language;
  • your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;
  • you should not be affiliated with competitors if posting negative reviews;
  • you may not post any false or misleading statements; and
  • you may not organise a campaign encouraging others to post reviews, whether positive or negative.

We may accept, reject, or remove reviews in our sole discretion. Reviews are not endorsed by us and do not necessarily represent our opinions. By posting a review, you grant us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, and sublicensable right to reproduce, modify, display, and distribute all content relating to the review.

11. MOBILE APPLICATION LICENCE

If you access the Services via the App, we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, strictly in accordance with these Legal Terms. The following terms apply when you use the App from either the Apple Store or Google Play:

  • The licence is limited to a non-transferable licence on a device that uses the Apple iOS or Android operating systems, in accordance with the usage rules in the applicable App Distributor’s terms of service.
  • We are responsible for providing maintenance and support for the App as specified in these Legal Terms; you acknowledge that the App Distributor has no obligation to do so.
  • You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo or designated as a ‘terrorist supporting’ country and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
  • You acknowledge and agree that the App Distributors are third-party beneficiaries of the terms in this mobile application licence and have the right to enforce them against you.

12. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to other websites (‘Third-Party Websites’) and third-party content (‘Third-Party Content’). We are not responsible for any Third-Party Websites or Content, and their inclusion does not imply our approval or endorsement. If you access Third-Party Websites, you do so at your own risk, and these Legal Terms no longer govern. You shall hold us blameless from any harm caused by your purchase of products or services from Third-Party Websites.

13. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict access to, or disable any of your Contributions; and (4) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

14. PRIVACY POLICY

By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in Australia. If you access the Services from any other region, you expressly consent to have your data transferred to and processed in Australia.

15. TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services.

WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE YOUR ACCOUNT AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your account, you are prohibited from registering a new account under your name, a fake name, or the name of any third party. Upon termination or suspension, we reserve the right to revoke or disable your access to any purchased eSIM profiles without liability to you.

16. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times. We may experience interruptions, delays, or errors. You agree that we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime.

17. GOVERNING LAW

These Legal Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

18. DISPUTE RESOLUTION

  • Informal Negotiations: To expedite resolution, the parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating legal proceedings.
  • Formal Proceedings: If the parties are unable to resolve a Dispute through informal negotiations, the Dispute shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.
  • Exceptions: The above provisions do not limit your rights under applicable consumer protection laws, including your rights to bring complaints to the Australian Competition and Consumer Commission (ACCC).

19. CORRECTIONS

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.

20. DISCLAIMER

Nothing in these Legal Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable legislation that cannot be excluded, restricted or modified by agreement.

To the extent permitted by law, the Services are provided on an ‘as-is’ and ‘as-available’ basis. You agree that your use of the Services is at your sole risk. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, in connection with the Services and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

21. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US.

22. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Legal Terms; or (3) your violation of the rights of a third party.

23. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit. You agree that we shall have no liability to you for any loss or corruption of any such data.

24. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES.

25. MISCELLANEOUS

These Legal Terms and any policies posted by us on the Services constitute the entire agreement between you and us. Our failure to exercise any right shall not operate as a waiver of such right. If any provision is determined to be unlawful or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services.
